Information on the principles of personal data processing and protection

Introductory Information

Our company strictly adheres to the protection of personal data and the privacy of its website visitors.
All procedures and measures adopted and implemented by our company in this area are consistently based on the current valid legal regulations on personal data protection and privacy, especially from

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation);
  • adaptational legal regulations of the Czech Republic, especially the Personal Data Processing Act, as well as
  • the Civil Code, no. 89/2012 Coll., and from Act no. 480/2004 Coll., on Certain Information Society Services.

In case of any changes to the affected legal regulations, we continuously adapt all our procedures and measures to these new regulations and changes.

If you provide us with your personal data in connection with our offer of goods and services and we further process such data, we become the personal data controller responsible for their proper processing and protection.

Our company High & Focused s.r.o., with its registered office at Milady Horákové 391/47, Holešovice, 170 00 Prague 7, ID no.: 08643431, which acts as a personal data controller in relation to customer and supplier personal data, is a commercial company engaged in retail sales of goods.
High & Focused s.r.o. as a controller carries out all personal data processing on the basis and in accordance with the obligations and requirements arising from the General Data Protection Regulation and other related legal regulations.
We process your personal data under the conditions stated below.

Processed Personal Data

Generally, to use our company's websites, it is not necessary to enter any input or access information and data that could be considered personal data. The provision of personal data is only necessary in essential cases where we need to contact you back or communicate further with you, especially if you are an e-shop customer or a registered customer.
To make a purchase in the e-shop, a customer can register or can make a purchase in the e-shop without registration. As part of the registration, they provide their contact and delivery details: first and last name, residential address, email address, phone number, delivery address, which are necessary for concluding the purchase agreement and delivering the goods. These data are secured by a password and email. An unregistered e-shop visitor is obliged to provide the following information to complete a purchase: first and last name, residential address, email address, phone number, delivery address.
Thus, we only process the personal data that you provide to us in qualified cases in connection with the purchase of goods offered and sold by us.
These are typically the following identification personal data that we necessarily need to carry out the respective transaction or other procedure or measure: first and last name, residential address, email address, phone number, billing address, delivery address.
Any processing of personal data is always tied to a defined purpose of processing and a corresponding legal basis for processing within the meaning of Article 6 of the General Data Protection Regulation, specifically: fulfillment of contract/contractual negotiations, fulfillment of legal obligations of the controller, legitimate interests of the controller, and consent of the data subject.
If the processing of your personal data occurs based on the legal title: Consent of the data subject (hereinafter "Consent"), processing is only possible for the duration of this Consent. If you withdraw your Consent and/or the period for which you granted Consent expires, further processing of your personal data is excluded.
In addition, certain other data may be available to us when you visit our website and actively use our services, namely IP address and cookies (in the case of online services), which we do not systematically process in relation to data subjects.
In case of your consent to sending questionnaires with purchase ratings via Heuréka.cz, your data (email address, information about purchased goods/service) may be provided to the operator of the Heureka.cz portal (Heureka Group a.s.).

Recipients of Personal Data

Apart from our company, personal data of data subjects are provided to third parties, especially for the purpose of fulfilling our company's legal and contractual obligations, which arise for us from the contractual relationship with the individual concerned:

  • For the purpose of goods delivery, your personal data to the necessary extent will be transferred to the carrier you designated for the delivery of the ordered goods. The data thus transferred include, in particular, your first and last name, delivery address, and telephone number where the carrier can contact you.
  • For the purpose of using marketing services, especially sending commercial communications or telemarketing, your personal data may be transferred to a third party acting as a processor, in accordance with Article 28 of the GDPR.
  • For the purpose of exercising the Operator's rights, your personal data may be transferred to third parties (e.g., our Legal Representative) or public administration bodies.

When paying the purchase price, your personal data related to payment cards and transactions are not processed. These personal data are processed by the respective payment gateway operated by a banking institution.
When processing personal data or providing them to third parties acting as processors, personal data are not transferred outside the territory of the European Union or the European Economic Area.

Processing Period

Your personal data will be processed for at least the duration of your contractual relationship with us.
Your personal data that are necessary for the fulfillment of our contractual or legal obligations may be processed or archived even after the termination of the contractual relationship, especially for the period specified by the relevant generally binding legal regulations.
Personal data processed on the basis of consent will be processed for a period of 5 years from the date of granting consent or until consent is withdrawn.

Persons under 16 years of age

Consent to the processing of personal data cannot be given by a person under 16 years of age. In the case of registration or granting consent for marketing purposes by a person under 16 years of age, consent must be given by the legal representative of the person concerned (parental consent).

Data Subject and their Rights

In the event of processing your personal data by High & Focused s.r.o. as a controller, you are in the legal position of a data subject who has all rights arising from the General Data Protection Regulation vis-à-vis the controller.
As a data subject, you have, in particular, the following rights under Articles 15 to 22 of the Regulation in relation to the controller:

  • the right to access personal data, in particular the right to request information from the controller about the processing of their personal data;
  • the right to rectification of personal data if the data are inaccurately maintained;
  • the right to erasure of personal data ("right to be forgotten");
  • the right to restriction of processing of personal data;
  • the right to object to the Controller against the processing of personal data;
  • the right not to be subject to automated individual decision-making, including profiling (with exceptions).

Security of Personal Data

In any processing of your personal data, we emphasize their effective security against leakage or misuse, particularly through necessary technical measures and securing our website and other information systems and software applications we use, as well as through binding internal procedures and organizational rules for personal data processing, including the confidentiality obligation of our employees.
In this regard, our company has also issued a Directive on the processing and protection of personal data at High & Focused s.r.o. and adopted specific technical, organizational, and other measures to secure both automated and manually processed personal data.
If another person – the personal data processor – is entrusted with further processing of personal data in a specific matter, this processing is detailed in a personal data processing agreement, which, in accordance with the General Data Protection Regulation, stipulates strict technical and organizational rules for the effective protection of data processed by the processor.

To improve our Online offer and enhance electronic communication with customers and members of customer and loyalty programs, we also use cookies.
Cookies are small text files that are stored on personal computers (PCs), tablets, or smartphones. These files allow us to create the conditions for optimal functioning of our websites for customers (users) and to further improve our offer and communication with you.
In this regard, however, it should be emphasized that cookies in no way allow access to a PC or other communication device and are not used for any collection of personal data.
