Information on the processing and protection of personal data

Introductory information

Our company consistently takes care of protection of personal data and privacy of visitors to its website.

All procedures and measures adopted and implemented by our company in this area are consistently based on the current applicable legislation on personal data protection and privacy, in particular on

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ( General Data Protection Regulation);
  • adaptation legislation of the Czech Republic, in particular the Personal Data Processing Act, as well as from
  • 89/2012 Coll. and from Act No. 480/2004 Coll., on certain information society services.

In the event of any changes to the relevant legislation, we continuously adapt all our procedures and measures to these new regulations and changes.

In the event that you provide us with your personal data in connection with our offer of goods and services and that we further process the data thus obtained, we become the data controller with responsibility for their proper processing and protection.

Our company High & Focused s.r.o., with registered office at Cimburkova 916/8, Žižkov, 130 00 Prague 3, ID No.: 08643431, which acts in the legal capacity of a personal data controller in relation to the personal data of customers and suppliers, is a commercial company engaged in the retail sale of goods.

High & Focused s.r.o. as the controller carries out all processing of personal data on the basis of and in accordance with the obligations and requirements arising from the General Data Protection Regulation and other related legislation.

We process your personal data under the conditions set out below.

Personal data processed

In general, no input or access information or data that could be of a personal nature is required to use our company’s website. Thus, the provision of personal data is only necessary in cases where it is necessary to contact you back or to communicate with you further, especially if you are an eshop customer or a registered customer.

To make a purchase in the e-shop, the customer can register or can make a purchase in the e-shop without registration. As part of the registration, the customer enters his/her contact and delivery details: name and surname, residential address, email address, telephone number, delivery address, which are necessary for the conclusion of the purchase contract and delivery of the goods. These data are secured by password and email. A non-registered visitor to the e-shop is obliged to provide the following data in order to make a purchase: name and surname, residential address, email address, telephone number, delivery address.

Thus, we only process personal data that you provide to us in qualified cases in connection with the purchase of goods offered and sold by us.

This usually includes the following personal identification data that we need in order to carry out the relevant transaction or other procedure or measure: name and surname, home address, e-mail address, telephone number, billing address, delivery address.

Any processing of personal data is always subject to a set purpose of processing and the corresponding relevant legal title processing within the meaning of Article 6 of the General Data Protection Regulation, in particular: performance of a contract/negotiation of a contract, performance of the legal obligations of the controller, the legitimate interests of the controller and the consent of the data subject. In case the processing of your personal data is based on a legal title: Consent of the data subject

(“Consent”), processing is only possible for the duration of this Consent. If you withdraw your Consent and/or the period for which you have given your Consent expires, further processing of your personal data is excluded.

In addition, some other data may be available to us by visiting our website and actively using our services, namely IP address and cookies (in the case of online services), but we do not systematically process these in relation to data subjects.

In case you agree to send questionnaires with evaluation of your purchase via Heureka.cz, your data (e-mail address, information about the purchased goods/services) may be provided to the operator of the Heureka.cz portal (Heureka Group a.s.).

Recipients of personal data

Outside of our company, personal data of data subjects are provided to third parties, in particular for the purpose of fulfilling our company’s legal and contractual obligations arising from the contractual relationship with the person concerned:

  • For the purpose of delivery of the goods, your personal data is transferred to the extent necessary to the carrier designated by you to deliver the ordered goods. The data so transmitted includes in particular your name and surname, delivery address and a telephone number at which the carrier can contact you.
  • For the purpose of using marketing services, in particular sending commercial communications or telemarketing, your personal data may be transferred to a third party in the capacity of an intermediary, in accordance with Article 28 of the GDPR,
  • In order to fulfil the rights of the Operator, your personal data may be transferred to third parties (e.g. our Legal Representative) or public authorities.

When paying the purchase price, your personal data relating to credit cards and the transaction is not processed. These personal data are processed by the respective payment gateway operated by the banking institution.

No personal data is transferred outside the European Union or the European Economic Area when personal data is processed or provided to third parties as an intermediary.

Processing time

Your personal data will be processed for at least the duration of your contractual relationship with us.

Your personal data that are necessary for the performance of our contractual or legal obligations may be processed or archived after the termination of the contractual relationship, in particular for the period of time specified by the applicable generally binding legal regulations.

Personal data processed on the basis of consent will be processed for a period of 5 years from the date of consent or until the consent is withdrawn.

Person under 16 years of age

Consent to the processing of personal data cannot be given by a person under the age of 16. In the case of registration or consent for marketing purposes by a person under 16 years of age, consent must be given by the legal representative of the person concerned (parental consent).

The data subject and his/her rights

In the case of processing of your personal data by High & Focused s.r.o. as the controller, you are in the legal position of a data subject who has all the rights arising from the General Data Protection Regulation against the controller.

As a data subject, you have in particular the following rights in relation to the controller within the meaning of Articles 15 to 22 of the Regulation:

  • right of access to personal data, in particular the right to ask the controller for information about the processing of your personal data;
  • the right to rectification personal data if the data are inaccurately recorded;
  • the right to erasure personal data (“right to be forgotten”);
  • the right to restriction of processing personal data;
  • the right to object to the Administrator against the processing of personal data;
  • rights not to be subject to automated individual decision-making, including profiling (with exceptions).

Security of personal data

In any processing of your personal data, we emphasize the effective security of your personal data against leakage or misuse, in particular through the necessary technical measures and security of our website and other information systems and software applications used by us, as well as through binding internal procedures and organizational rules for the processing of personal data, including the confidentiality obligations of our employees.

In this regard, our company has also issued Directive on the processing and protection of personal data at High & Focused s.r.o. and has adopted specific technical, organizational and other measures to secure both automated and manually processed personal data. In the event that another person is entrusted with the further processing of personal data in a specific matter – personal data processor – this processing is regulated in detail by a data processing contract which, in accordance with the General Data Protection Regulation, lays down strict technical and organisational rules for the effective protection of the data processed by the processor.

Cookies

In order to improve the quality of our Online Offerings and improve electronic communications with customers and members of customer and loyalty programs, we use, among other things, files cookies.

Cookies are small text files that are stored on personal computers (PCs), tablets or smartphones. These files enable us to create the prerequisites for the optimal functioning of our website in relation to our customers (users) and to further improve our offer and communication with you.

However, it should be stressed in this respect that cookies in no way allow access to a PC or other means of communication, nor are they used for any collection of personal data. You have the right and option to refuse the cookie function and to cancel/disable it on your ICT device at any time.
